The metaverse the new reality of human rights, a challenge for effective judicial protection

This article explores the challenges concerning the effective judicial protection and human rights within the metaverse, to meet this objective the relationship that the user has with his avatar from the psychological and sociological point of view was addressed, reaching the conclusion that the avatar functions as an extension of the person, we use this reason to explore the development of the legal personality and the jurisdictional tutelage within the metaverse consulting for this purpose jurisprudence of the Colombian constitutional court and the concepts of some treatises of law to explain the evolution and the application that the previous legal concepts have in front of the avatar, we also analyze the abstraction of human rights within the metaverse. We suggest that these challenges need regulation by the law in a substantial and procedural manner, also implying an evolution of human rights seen from the virtual interaction within the metaverse.
